Welcome to JustPop! (“Service”), operated by Overday Labs (“Company,” “we,” “us,” or “our”). By accessing or using JustPop!, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
JustPop! is an AI-powered social media content creation platform that generates images and posts for businesses using generative artificial intelligence technology. The Service may automatically publish content to connected social media accounts on your behalf.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using JustPop!, you represent and warrant that you meet these requirements.
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
JustPop! operates on a subscription basis with various tiers (Creator, Pro, Agency). Each tier includes a monthly allotment of generation credits and access to certain features as described on our pricing page.
“Credits” represent a limited, non-exclusive, non-transferable, revocable license to access the generation features of the Service. Credits are not property, currency, stored value, or a financial instrument of any kind. Credits have no monetary value and are not redeemable for cash, refunds, or any form of compensation under any circumstances.
The license to use credits is granted solely as a benefit of your active subscription and is conditioned upon your continued subscription in good standing. We reserve the right to modify, limit, or revoke credits at any time, including but not limited to upon termination or cancellation of your subscription, violation of these Terms, or discontinuation of the Service.
Credits are consumed each time you generate content through the Service. Each generation request consumes credits regardless of whether you are satisfied with the output. This is the nature of generative AI technology—computational resources are consumed during the generation process, and credit consumption reflects that usage. There are no refunds, returns, or credits restored for generations you are unsatisfied with.
If you wish to regenerate content, request changes, or create variations, each subsequent generation will consume additional credits. We encourage you to provide clear, detailed prompts to maximize the quality of your first generation.
While your subscription remains active and in good standing, unused credits accumulate and carry over month to month without expiration. However, your license to any unused credits terminates automatically and immediately upon the end of your subscription, whether due to cancellation, non-payment, termination for cause, or any other reason. Upon termination of your subscription, all unused credits are forfeited with no right to refund, compensation, or reinstatement.
You expressly acknowledge and agree that the forfeiture of unused credits upon subscription termination is a material term of this agreement, that credits have no value outside of an active subscription, and that you have no expectation of retaining, recovering, or being compensated for unused credits after your subscription ends.
You may purchase additional credits at any time at the rates specified for your subscription tier. Additional credits are subject to the same license terms as subscription-included credits: they represent a revocable license, have no cash value, and are forfeited upon termination of your subscription. The purchase of additional credits does not extend your subscription or create any independent right to use the Service.
Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law. We reserve the right to change pricing with 30 days' notice.
You may cancel your subscription at any time through your account settings. When you cancel, your subscription remains active until the end of your current billing period—you keep full access to the Service and your credits until then. For example, if you cancel on day one of a monthly billing cycle, you retain access for the remainder of that month. At the end of the billing period, your subscription ends and any remaining credits are forfeited. No partial refunds will be provided.
You agree to use JustPop! only for lawful purposes and in accordance with these Terms. You are solely responsible for all content you create, generate, or publish using the Service.

We reserve the right, but are not obligated, to review content generated through the Service. We may, in our sole discretion, immediately suspend or terminate your account and access to the Service without prior notice or refund if we determine that you have violated this Acceptable Use Policy. We may also report violations to law enforcement authorities where appropriate.
You retain ownership of the content you create using JustPop! Subject to your compliance with these Terms, you own all rights, title, and interest in the images and other content generated through your use of the Service. You are free to use, modify, distribute, sell, or otherwise exploit your generated content for any lawful purpose.
By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely as necessary to provide the Service to you. This includes transmitting content to third-party AI providers and social media platforms as required for the Service to function.
The Service, including its design, features, and underlying technology, is owned by Overday Labs and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
AI-generated content may inadvertently resemble existing copyrighted works. You are responsible for ensuring your use of generated content does not infringe on third-party rights. We make no representations or warranties regarding the originality or non-infringement of generated content.
JustPop! uses generative artificial intelligence technology to create content. You acknowledge and agree that:
The Service integrates with third-party platforms including but not limited to Instagram, Facebook, LinkedIn, and X (Twitter). Your use of these integrations is subject to the terms and policies of those platforms. We are not responsible for the actions of third-party platforms, including their suspension of your accounts for any reason.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVERDAY LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Overday Labs and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your generated content.
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms from time to time. Material changes will be communicated via email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease, and any remaining credits will be forfeited.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Overday Labs regarding the Service and supersede all prior agreements and understandings.
